Facilitations and facilities in the law for the allocation of real estate necessary for the establishment of investment projects

The Investment Law included a package of incentives and facilitations regarding the allocation of real estate necessary to establish investment projects, as it granted the investor the right to obtain the real estate necessary to initiate or expand his activity, regardless of his percentage of participation or contribution to the capital.

The law stipulates that the rules for some real estate located in geographical areas regulated by special laws be observed, either through the entity that has jurisdiction over the real estate in accordance with the rules stipulated in its laws and regulations after announcing them, or through the Authority in accordance with the disposition provisions stipulated in this law.

The law obligates the administrative authorities with jurisdiction, after coordination with all competent authorities and the National Center for State Land Use Planning, within ninety days from the date of implementation of this law, to provide the Authority with detailed maps specifying all properties under its jurisdiction and available for investment, in addition to a complete database that includes location, area, and heights. Approved, estimated price and investment activities that are appropriate to their nature and method of disposal. These entities are also committed to updating these data periodically every six months or whenever the Authority so requests.

The President of the Republic, after the approval of the Council of Ministers, shall issue a decision to transfer ownership, jurisdiction, or supervision of some real estate from the administrative authorities with jurisdiction to the Authority whenever the implementation of the investment plan requires it, provided that the Authority shall dispose of it in accordance with the provisions of this law.
